E3/AS1 Wet Area Flooring Requirements: A NZ Guide

Few details cause more confusion at building consent than the flooring in a bathroom, kitchen  or laundry. A floor that performs beautifully in a living room can be quietly non-compliant the moment it crosses the threshold into a wet space and that distinction has caught out plenty of renovators, builders and homeowners since the rules tightened in 2021. Get it wrong, and you risk a floor that swells and delaminates, or a consent held up at inspection.

Understanding the E3/AS1 wet area flooring requirements removes the guesswork. This guide walks through exactly what New Zealand's Building Code asks of floors in wet areas, which finishes are acceptable, how products like hybrid and vinyl gain approval through an Alternative Solution, and the common mistakes worth avoiding. Whether you're specifying for a single bathroom or coordinating a full build, the goal is the same: a floor that's compliant, durable, and built to handle real New Zealand living.

What Does E3/AS1 Actually Require for Wet Area Floors?

Clause E3 Internal Moisture is the part of the Building Code concerned with controlling moisture inside a building. Its purpose, as set out by Building Performance, is to safeguard people against illness, injury and loss of amenity caused by moisture accumulating and to protect adjacent household units from water damage. In practical terms, that translates into three demands on a wet area floor: it must be impervious, easily cleaned, and supported by adequate ventilation.

The objective behind the clause

"Impervious" is the operative word. According to Building Performance, surfaces in wet areas must not allow the passage of moisture, must be straightforward to clean, and must sit within a space that's properly ventilated to avoid fungal growth. The reasoning is grounded in building science: regular, localised wetting is expected in these rooms, and a porous floor simply transfers that moisture into the structure beneath.

Acceptable Solution versus the performance clause

It's worth separating two things that often get blurred. The performance clauses E3.3.3 and E3.3.5 require impervious surfaces around sanitary fixtures and appliances, but the Code provides no verification method for proving compliance. The ‘Acceptable Solution’, E3/AS1, is the deemed-to-comply pathway: follow it, and you've met the requirement. Anything outside it is an ‘Alternative Solution’, which we'll cover shortly.

The three acceptable wet area finishes

Under E3/AS1, the finishes recognised as an ‘Acceptable Solution’ for water-splash areas are clear and specific. As Level outlines, they are a slab-on-grade concrete floor with a steel-trowelled or polished finish (sealed at the edges, in limited applications), ceramic or stone tiles with a maximum 6% water absorption and waterproof grouted joints over a waterproof tanking system, and an integrally waterproof sheet material such as PVC vinyl with sealed joints, coved or sealed at the edges. Each one shares the same trait: water has nowhere to go.

What Counts as a "Wet Area" Under the Building Code?

Before you can specify the right floor, you need to know where the rules apply. The definition is more precise than most people assume, and it has nothing to do with how often a room feels wet.

Spaces with sanitary fixtures or appliances

Under Clause E3, a wet area is the floor surface of any space containing sanitary fixtures or sanitary appliances. In a typical home, that means bathrooms, kitchens, laundries and toilets. A kitchen counts because of the sink and dishwasher, a laundry because of the tub and washing machine the presence of the fixture, not the puddle, is what triggers the requirement.

How far the impervious finish must extend

The impervious surface doesn't always have to cover the entire room. The finish must extend to the doorway and all walls of the room, or in open-plan layouts where the space flows into a living area at least 1.5 metres from any sanitary fixture or appliance, as explained in BRANZ Build. In practice, many specifiers run a single compliant floor right through the open-plan zone to avoid awkward transitions and material changes at a doorway.

What isn't a wet area

Just as importantly, the clause doesn't apply everywhere. Living rooms, dining spaces, hallways, bedrooms and front entrances aren't wet areas, so the impervious requirement doesn't extend to them. This is why a timber floor remains a perfectly valid choice through the living zones of a home, even when it can't be specified into the bathroom as an Acceptable Solution.

Why Timber Was Removed, and What Changed in 2021

If you've read older guidance and found it contradicts a recent inspector's comment, this is usually why. The acceptable finishes for wet areas were narrowed significantly a few years ago, and the change reshaped how timber-look floors are specified.

Amendment 7 and the shift to Alternative Solutions

Timber and timber-based products including particleboard and similar substrates were removed from the Acceptable Solution in E3/AS1 Second Edition Amendment 7, published in November 2020 and taking effect in November 2021. As Building Performance confirms, timber is now treated as an Alternative Solution for compliance with Clause E3 rather than a deemed-to-comply finish. The material isn't banned from wet areas; it simply needs a documented, engineered case for approval.

What this means for engineered oak and laminate

The change matters most for products with a moisture-susceptible core. Engineered oak and laminate flooring the latter built on a high-density fibreboard core are excellent choices through dry living areas, but their cores remain vulnerable if water reaches them. In a wet area, they can only be specified through a properly designed ‘Alternative Solution’ with the supplier's compliance documentation behind it.

The five-year durability requirement

There's a durability dimension too. Floor coverings, protective or acoustic coverings must meet a minimum five-year durability requirement under Clause B2, which sits alongside E3. A compliant wet area floor therefore needs to be both impervious on day one and demonstrably durable over time a standard that rewards well-engineered products and exposes weak ones.

How Do Hybrid and Vinyl Floors Meet E3 in Wet Areas?

This is where modern flooring science earns its place. Hybrid and rigid vinyl floors weren't on the original ‘Acceptable Solution’ list, yet they're among the most reliable wet area surfaces available provided they're specified and installed correctly.

The Alternative Solution pathway

A waterproof hybrid or vinyl floor reaches compliance through the ‘Alternative Solution’ route. Reputable suppliers provide compliance documentation often a Producer Statement or an Alternative Solution compliance document citing relevant lab test reports that can be submitted as part of a building consent application. These supporting documents demonstrate that the product, installed as specified, delivers the impervious, easily cleaned surface that Clause E3 demands. For new builds and major alterations, it's worth confirming this paperwork with both your installer and supplier before you specify.

The role of perimeter sealing

Compliance isn't just about the plank it's about the system. When a rigid hybrid floor is installed as a floating system with a foam backer rod and a silicone perimeter seal, the result is a continuous, sealed surface with no path for water to reach the subfloor. Why rigid core stays waterproof

The performance comes down to composition. One caveat worth noting: no hybrid product is approved for use inside a shower enclosure.

Is Slip Resistance Part of E3? What the Code Really Says

Here's a point of genuine confusion worth clearing up. Slip resistance and moisture control are often discussed together, but they're governed by entirely different parts of the Building Code and conflating them leads to over-specification or, worse, a false sense of compliance.

E3 is moisture; slip sits under D1

Clause E3 concerns moisture, not safety underfoot. Slip resistance falls under Clause D1 Access Routes, which requires walking surfaces on access routes to be safe and not slippery under normal conditions. So when you're meeting E3, you're addressing imperviousness slip resistance is a separate consideration that may or may not apply to the same floor.

Common E3/AS1 Compliance Mistakes (and How to Avoid Them)

Most wet area flooring problems trace back to a handful of avoidable errors. Knowing them in advance is the simplest way to keep a project on track.

Specifying the wrong product without an Alternative Solution

The most frequent misstep is specifying timber or laminate into a wet area as though it were still an Acceptable Solution. Since Amendment 7, that pathway no longer exists these products require a documented ‘Alternative Solution’. Choose a product with a moisture-proof core, or secure the engineered compliance case before you commit.

Skipping the perimeter seal

A waterproof plank installed without a sealed perimeter is not a compliant wet area floor. The foam rod and silicone seal aren't optional finishing touches they're the mechanism that makes the surface continuous and impervious. Cutting this detail is one of the easiest ways to undermine an otherwise sound specification.

Ignoring subfloor moisture

Compliance starts beneath the floor. Concrete slabs should read a relative humidity of 75% or less, and plywood subfloors a maximum moisture content of 20%, before any floor is laid guidance reflected in BRANZ Bulletin 585. Laying over a damp subfloor invites failure regardless of how waterproof the surface above it is.

Leaving the paperwork until last

Finally, don't treat documentation as an afterthought. For consented work, the supplier's Alternative Solution compliance document or Producer Statement should be in hand before the application goes in, not scrambled for at inspection. Early alignment between specifier, installer and supplier is what turns a confident specification into a signed-off one.
